What type of lien in California can I do to recover labor and tools .

CaliforniaMechanics LienRight to Lien

I’m a general contractor and had a verbal contract with a client (Who I’ve done the exact same type work for her before except a smaller scale) About 70% of the work was done and I get a text saying she has an unfavorable doctor visit and will let me know when to resume/finish work. When I went to her house I saw her sanders and her shopvac outside. (I’m assuming she is trying to finish floors by herself) She hasn’t paid me at all and I have bought most of the materials myself. She refuses to respond to any of my text and phone calls and won’t answer the door so I can at least get me tools. What type of lien can I file in (Shasta County) Redding, California.

When unpaid for construction work in California, contractors can generally utilize a mechanics lien in order to force payment. And, to be sure, California lien claimants don't need to have a written contract in order to file a mechanics lien. If you'd like more information about how to file a California mechanics lien claim, these two resources should be invaluable: - California Mechanics Lien Guide and FAQs - How to File A California Mechanics Lien – Step By Step Guide To Get You Paid As I'll discuss more below, though, note that mechanics liens are generally considered the nuclear option - so pursuing some other recovery method before diving into a lien claim may be worthwhile.

Recovery options before filing a California mechanics lien

For one, sending a payment demand letter can push for payment without escalating the dispute too far. A demand letter lets the customer know you're serious about getting paid and willing to do whatever it takes to get paid what you're owed. But, it also provides the customer with an opportunity to make payment before things get too ugly. Taking things another step further with a Notice of Intent to Lien can lead to payment, too. A Notice of Intent is a warning shot, and it let's customers know that if payment isn't made and made soon, then a lien filing is imminent. Considering the drastic nature of lien claims, customers will have no choice but to make the payment claim seriously. Plus, if it's unsuccessful, a claimant can always pursue their claim.
