What to do when the contractor stops showing up?

PennsylvaniaConstruction Contract

Hi...our contractor just one day decided to cleanup and cleared out...no communication, just didn’t come to work again. T&M contract through the end of January with a list of items that they didn’t complete. What should I do?

There are a few steps to take when a contractor decides to stop showing up to the project. Before doing anything, it's important to take a look at the termination provisions in the contract executed between you and the contractor. Termination might be the best move in this situation, and it's important to follow any notices, alternative dispute resolution, or other requirements under the termination provision. You should contact a local attorney to advise you on how to proceed. If the contractor is licensed, you could also file a complaint with the state contractor licensing board. And lastly, if the contractor was paid more than what was performed, a lawsuit in small claims court  (if the amount is less than $12,000) court might be the best means for recovery under breach of contract or unjust enrichment. Again, contacting a lawyer is highly recommended. The PA Bar Association Lawyer Directory and Avvo.com are good places to start.
