What is the implied builders warranty. Is it state specific.

Hello, is there a place I can find an implied builders warranty applicable to Mo? Thank you

The warranties imposed on construction participants by public policy, and outside of the contract itself are state-specific. In Missouri, for example, there is an implied warranty that the new construction of a home (and the appurtenant structures) will be free from latent defects, but the warranty is only applicable to the new construction of the home against the builder-contractor, and only by the original purchaser of the property. Additionally, vendor / builder-contractor can disclaim this implied warranty, if specific wording to do so is used in the contract for purchase. There may be express warranties in place as part of the construction contract, whether specifically identified as to certain aspects of the construction, or a general warranty that the work will be performed in a "workmanlike manner."
