We had a job through a landscaper where we just built a pergola in the backyard and the landscaper has not paid us on the job since Feb 15 when it was completed.

I'm not sure exactly what you are asking about the customer's role. If you were not paid by the landscaper, then you have a claim against the landscaper for breach of contract. You may also have a claim against the home owner for unjust enrichment, but that claim may be a little tougher to make depending on what the facts are.
