what can i do if i feel i was wrongfully terminated

preforming utilities on job. MMUD Inc. is about 99 percent done we were working on final inspectional. we recieved a 48 notice than a termination because we did not have inspections. because they did not follow our VOS and we did not pracrice our lien rights they are holding 116,000.00

When was the last time you performed work on the job?

First, we would want to evaluate your lien rights on the job. If you do not have any lien rights remaining, you may still be able to sue in District Court for breach of contract, promissory estoppel (or quantum meruit), violation of the prompt payment act, Rule 185, and a few others.

Liens help put pressure on the Property Owner to get you paid but you are not completely lost without a lien.

You should consider preparing a letter to mail by certified mail, return receipt requested, to your customer to set out the facts and to demand the relief that you want. Attach support for your position, and your invoice for work performed to the date of termination, plus lost profits on the work that you were kept from performing. Make sure that your letter is professional and business like as it may be evidence later. Retain a construction attorney to evaluate your legal position and to provide advice. The advice may be different depending on whether you were a contractor directly with the owner or were a subcontractor. If you were a subcontractor, you may have rights to make a claim against a payment bond (if the project had one), or you may have mechanic's lien rights if the project is owned by a private owner.
