An Illinois Notice of Intent to Lien (NOI) is required from any party on a private project that didn't contract directly with the property owner. This can be sent anytime during the project, but it must be sent to the property owner within 90 days of the last furnishing of labor or materials to the project. In order to be valid, it must be sent by certified mail, with return receipt requested and restricted delivery to the owner. The one interesting aspect of the Illinois NOI, is that it may not be required if the sub is not only listed on the GC's sworn statement, but an accurate account of the amount owed to them. However, there's no reason to leave your payment fate in the hands of the GC. It's important to send one regardless, to be certain your full IL mechanics lien rights are secured.
