What are the next Steps after filing and getting a lien on a house?

Utah

We have finished a project and the client is refusing to pay. We have a lien placed on the home. What are the next steps to get paid?

Hi Tamara,

If you have filed a timely preliminary notice and timely recorded your notice of construciton lien, then the next step is to file a lien foreclosure lawsuit and record a lis pendens. You have 180 days from the date you recorded the lien to file your lien foreclosure lawsuit. Feel free to call or email me with any questions. My phone number is 801-365-1024 and my email is nathan@snjlegal.com.

Thanks, Tamara.

The next step is to file a lawsuit to enforce the lien and, at the same time, record a lis pendens. This should be done by your attorney. The lawsuit must be filed within 180 days of the date you recorded your lien notice of your lien will expire.

If you need an attorney I would be happy to help you. I have been enforcing construction liens for over two decades. It’s what I do.
