Once a release bond is recorded you have 6 months from the date of notice of the release bond to bring suit on the mechanics lien release bond. The procedure is to file a complaint in superior court against the surety for the release bond as well as the contractor/owner that has failed to pay you which includes a cause of action for Claim on Mechanic's Lien Release Bond. You may also want to include alternative causes of action for breach of contract, etc. I recommend that you retain an attorney to assist you in doing so but it is possible to file your action on your own "in pro per."
