After a Notice of Intent to Lien is filed, s potential lien claimant must make the decision if they want to move forward with the next step and actually file a mechanics lien to encumber the property and secure the amounts due. In NY, a mechanics lien must generally be filed within 8 months of last furnishing labor or materials to the project, but that time period is shortened to 4 months when the work was on a single family dwelling. Filing a lien can be a big decision, as it is a very powerful tool and can result in relationships deteriorating, or projects grinding to a halt. However, it is a strong tool to make sure payment is eventually made. A mechanics lien can be filed easily through the use of online tools, or by other means, like enlisting the services of an attorney. If the potential claimant decides not to move forward with a lien filing, the debt can be outsourced to a collections agency, a demand letter can be sent from an attorney threatening a lawsuit, or a lawsuit can be filed.
