What and How do I proceed with a process to enforce my Constitutional (Mechanics) Lien in Texas

TexasLien Foreclosure

Hi Levelset Experts, I have a mechanics lien already filed from September 2019 for work I did in May 2019 but did not get paid for. My understanding is that I have to get an Abstract of Judgement from the Courthouse I obtained the lien from, and then do I need to file a notice of intent to force sale to satisfy my lien, or do I need to send a notice of default first... Not sure of the process for a lien... My lien is for almost $10,000.00 US...

For comprehensive guidance, please refer to: https://www.levelset.com/mechanics-lien/texas-lien-law-faqs/ Since you have some time to have the lien enforced, unless you've already exhausted efforts to collect payment owed, you should certainly attempt to do so. Provided your lien is valid and payment owed to you is undisputed, you have the benefit of considerable leverage to collect payment quicker and more cost effectively than going the legal route. As well, absent a situational element that may dictate otherwise, the project owner should much prefer to settle matters with perfected lien holders quickly and voluntarily, rather than being forced to cure a more costly encumbrance rife with additional legal hassles later.

If I can ever be of assistance to your company in the collection of any unpaid commercial project invoices, please don’t hesitate to contact me.
