We released a lien on Palmetto Mini Storage.

FloridaConstruction Contract

We released the lien several months ago and was told they had come to an agreement. We have tried to reach out to the owner and contractor several times with no response. We are outside of our lien right. What should we do?

An attorney familiar with construction law should be consulted. Examining the actual lien release signed as well as the agreement with the contractor would be necessary to provide a proper answer. However if the time has passed to record a claim of lien, there are likely still contract and equitable claims available.

It sounds like you are saying that they promised payment was forthcoming if you let your lien rights pass, and then never paid. If so, you cannot lien, but may be able to sue to have the Court impress an equitable lien on the property, and/or bring claims against those who made those promises to you under section 713.31 Florida Statutes.
