We missed the deadline for filing NTO, can we still obtain payment due?

We were terminated from a project in Tampa, we are from Orlando, contract was terminated for convenience per the notice of termination. We missed the deadline for filing NTO, they are withholding payments from prior of any disputes as well as currently due amounts. We believe we were wrongfully terminated and have documented all of the events. Is there a way of obtaining payment due. (Considerable amount of money)

The notice to owner is a prerequisite to having lien rights if you do not have a direct contract with the owner. If you do have a contract with the owner then you must file your lien within 90 days of your contract being terminated. Even if you do not have lien rights you do have the right to be paid by the party hiring you. Your contract will likely provide payment conditions. I strongly suggest that you confer with a lawyer about your rights and any conditions that have to be fulfilled before payment can be forced through legal action.
