We just picked up some work in New Mexico. We need to understand licensing requirements.

We are a Pipe Supply company that operates in the South. We do not generally operate in New Mexico, but picked up job. I read that New Mexico has strict requirements. ". If the claimant is required to have a license by the Construction Industries Licensing Act, the claimant must be licensed in order to claim a lien." Are material suppliers required to have licenses per the Construction Industries Licensing Act?

Material suppliers typically do not need to be licensed in a state to supply materials there. Under NM Stat § 60-13-3, those who merely supply materials for others to install and/or fabricate are not considered a "contractor." And, because that definition is used for establishing who must be licensed as a contractor, those who merely supply materials in New Mexico should not have any licensing requirements (and this should be true for most other states, as well). With that being said, I'm not an expert on licensing requirements in New Mexico. So, if this is a point of concern, it'd be wise to reach out to the New Mexico Regulation & Licensing Department or to a local New Mexico construction attorney for additional clarity.
