Untrue claim on lien

FloridaLien Releases

I was contact by a mitigation company said a lien was filed two years ago ( without my knowledge ) on a roof job that’s was completed and paid thru insurance 3 years ago. It’s a total surprise for me and the amount is $2000. I felt being scammed but don’t want to take it lightly. What option do I have? Do I ignore the mitigation company or ? The roof company was already closed out due to law suit and they transferred the “ balance” to another company now it’s with some profession collector. Advise appreciated

If a claim of lien was actually recorded against your property, it expires by its own terms after one year. This is really a consumer protection issue and raises several red flags for potential violation of fair debt collection practices. Consult with a consumer defense attorney (most offer free consultations) regarding the specific facts of this matter. I wish you luck.

A person who records a lien has one year from the date of recording to file suit to foreclose on the lien claim. After one year, the lien becomes null and void and is unenforceable.

If the lien was filed two years ago, and the lienor didn’t sue to foreclose the lien within a year, then the lien has expired and you don’t have to do anything.
