Unconditional Waiver

TexasChange OrdersLien Waivers

I was requested to sign an unconditional waiver on the final payment, however, a change order was recently requested. I'm hesitant to sign it since the change order amount was not applied.

A Final Unconditional Waiver is appropriate when all work has been completed and all payments have been waived. Thus, the Final Unconditional Waiver should really be the final closeout of the job. If not all payments have been received or not all work has been done, a Final Conditional Waiver, Progress Conditional Waiver, or Progress Unconditional Waiver might be more appropriate. You can request that signing of the final unconditional waiver be held off until completion of the change order or you can submit one of the other progress waivers that would be more appropriate.
