Subcontractor issues in colorado

I am a contractor and my supplier for concrete did not supply the correct concrete per our spec. They did not fix it and we had to go elsewhere. They are now putting a lien on the project and requiring money. No contract was signed. How can I avoid the lien? What are my rights?

To have a lien right a written contract is not required. You should always use proper contracts drafted by your attorney, but the fact that you did not have a signed contract means nothing as to lien rights. The question is whether the supplier followed the lien requirements to the letter as to timing, form, amount, and service. Until you hire an attorney to review all that we cannot tell you about the rights related to possible lien forfeiture and a suit to remove that lien. Another question arises as to damages. Since you did not use a written contract you really harmed your options, but if the supplier did not provide the materials per the oral contract terms and you had to spend more elsewhere you may have a claim for breach and damages. This, as the other matter, cannot be determined until an attorney is hired and they get more facts.

If I'm working for an owner but not the owner which is my focus going forward apparently the ones I'm working for basically subbed out the job to me but I'm having a hard time getting paid
