Sub of Sub lien rights, filing of NTO timing and lien rights.

We are a subcontractor of a sub., project located in Florida. Due to error on our part, we failed to file a notice to owner when we started a job in May 2021. We finished our portion in December 2021. I saw on your website that a sub of a sub can still file a "NTO" provided the Contractor and Subcontractor have not been paid in full. Does this also give us lien rights provided we now send a NTO and they have not receive their final payment.

You can always deliver a notice to owner (NTO) to inform the owner and perhaps others that you have not been paid. But you do not have lien rights as a result of the untimely delivery. Remember also, that to preserve lien rights as a sub-subcontractor you must "deliver" a copy of the NTO to the general contractor.
