Should i still file a prelien if it is after the 20 days in California?

We missed our deadline to file the prelien notice but we have still not been paid so I am wondering what we should do in order to get paid without risking us getting sued for not doing the correct steps.

Assuming you are still working on the project, or have provided labor or material within the last 20 days, yes, because the 20-day preliminary notice reaches back to cover labor and material provided within 20 days of service (mailing, via certified mail, return receipt) of the notice.
