SECONDARY NOTICE OF DEFECT OF SUPPLIES

OregonConstruction ContractDefectsLawsuit

We received a secondary notice of defect under ORS 701.565. We supplied construction co w/ materials over 1 yr ago and our invoices and packing slips all have stated notices of claims needing to be made within 5 business days of receipt of the products. The complaint assessment detail has no mention or photos of defective materials that we can find or see; the complaint notates poor installation and damage from not protecting surfaces throughout construction - all of which occurred after receipt of goods. How do we write a request for visual examination of the residence and who do we send it to? Do we send it to the attorneys involved or the homeowners directly? Do we need an attorney to do this for us? If so, do we get reimbursed legal fees if we are found not liable? Not sure how this all works. Thank you.
