Same Project / Different Contracts

I'm on a large project that we properly NTO'd - The contractor has issued us a new separate contract for additional work. How do we proceed with a new NTO - since the first date of work is far back? Do we use the new contract date?

Is the new work a continuation of the previous work, or a different scope or type of work?

Same type of work as previsouly completed. Just a difference of below grade waterproofing and above grade waterproofing.

If you have been off the job and are now being brought back to it with a new contract careful practice dictates that you should do a new NTO based on the new contract. Remember, the 45 day clock to deliver the NTO commences the earliest date of putting materials on the site or starting work related to the new contract.
