Residential Kitchen Contractor breach of contract

We hired a contractor to remodel our kitchen last year. The contract that we signed contained a 2 year warranty on the completed work. Almost a year later, the flooring they installed is failing, and we invited the contractor back to evaluate. He agreed that the flooring was installed incorrectly, and he agreed to fix it under the warranty. He even agreed via an email communication that if he didn't have it fixed by a certain date, he'd pay us the cost of labor and materials ($3,500.00). The agreed upon dates came and went. When we asked for followup, he stated he's going out of business and cannot complete the fix. Do we have a case to either get the flooring fixed, of the financial compensation back from the contractor? What would be our first step to start this process?
