My architect filed a Mechanic's lien 3/10/2020 (received 3/16/2020). I think it is wise to (1) challenge the lien (for $18,912) under section 19 of the lien law for incomplete, defective, and deficient work, (2) Demand to Foreclose, and then make a special proceeding to discharge the lien. I am being charged for work that I did not consent to (I specifically asked that the work not be done) and for work that was not done at all. And, as the architect willfully exaggerated the lien I would request that he be responsible for attorneys’ fees, bond sums, and additional damages equal to the amount by which the lien is found to have been exaggerated.[10] N.Y. Lien Law §§ 39, 39-a. I am in NY County NY. How would I get this done procedurally? And, Courts are closed to to Corona virus.
