Reinstating a lien

ColoradoLien Deadlines

We completed a job and homeowner did not like the colors they chose. They have refused to pay their final invoice (roughly 13k). We filed a lien on their property Feb 14th and I believe in CO a lien has to be refiled every 6 months. Please advise

Generally, it is best to retain a competent attorney who can help find a payment solution while complying with available lien protections and attempting a prompt out-of-court resolution.

You definitely want to talk to an attorney about that understanding, and whether the lien is even worth it to pursue in light of alternatives that may be more cost effective and equally beneficial.

Dear Contractor – The deadline to foreclose a lien in CO is 6 months from either project complete or last work (you can use either date). The lien expires one year after recording; unless in the 13 months, you record an affidavit that the project is not completed.

(Disclaimer: Our firm is not representing you, is not accepting your case and has not reviewed or checked the validity or timeliness of your mechanic’s lien. We are responding to your question above)
