Recorded Preliminary Notice

Hello. We sent a recorded preliminary notice to a customer on accident. The customer has already paid their bill, so naturally they were unhappy to receive this notice. Is there a lien release or something I can send to the county to ease their mind? The customer is concerned about this being an issue if they try to sell their home. Thanks Megan

Hello Megan, When you say recorded preliminary notice, what do you mean by "recorded"? I have had clients ask similar questions (e.g., "what can I do if I want to 'withdraw' a prelim?"), and the answer is that you can either do a simple letter on your letterhead or you could a statutory waiver and release assuming you are paid in full on the project.
