CaliforniaLien Deadlines

Hello I had some questions about filing and sending “Intent to file a mechanics lien” in California. I had never had to do this prior to this past year business and I am a new contractor. I’ve been trying to educate myself but I could use assistance. My questions mostly revolve around timeline necessary for sending such documents and escalation of documents. The project is been completed and was started over a month and a half ago without filing any pre lien. I have a plethora of questions any assistance would be greatly appreciated.

Hello subcontractor, you have to file the preliminary notice within 20 days of starting the project. If you did not timely serve the preliminary notice is only valid for work performed and materials delivered up to 20 days prior to whenever it is served. See Business and Professions Code 8204. If you timely served the preliminary notice then you must file the Mechanics Lien within 90 days after completion of the project, unless a notice of completion or cessation was filed by the owner, in which case you only have 30 days. See Business and Professions Code Section 8414.
