Property that I need to lien is owned partially by the City of Fort Worth

I am a material supplier who was left unpaid by a subcontractor on a commercial apartment building job. I sent monthly notices and notice to lien to the property owners and the GC. Now I need to file the lien. I have found that the property is owned partially by the City of Fort Worth - is there anything special I need to do because of this? Thanks!

Hello,

Yes. Because there is a likelihood this was part city project, you will need to find mail the surety a copy of the lien notice. The surety is the insurance company that wrote the payment bond for the project. If it is even partially connected to the city, the GC on the project may have been required to post a payment bond and that's where your money should be coming from. Most liens against city owned property generally is not valid but you would still need to perfect in the ordinary fashion.

You are taking all of the right steps, just find that surety. The GC would have that information.
