GeorgiaMechanics Lien

I am a contractor. The property owner is requesting a copy of the invoice that has not been paid yet. I have requested an answer to this numerous time. Please someone call me.

If you've filed a mechanics lien, it's absolutely normal for the property owner to want a copy of your unpaid invoice(s). They'll want to make sure that your payment claim is valid and that you haven't already been paid - and that's fair. In terms of whether that request should be granted - I suppose that's up to each claimant. But, if you want to be paid for your work, showing the owner what you're owed should be an expected part of the recovery process. At the same time, it's perfectly normal for you to be skeptical of someone on the other end of your payment dispute. If you're wary of sharing that information, then consulting with a local Georgia construction attorney for help in negotiations could be useful. What can I do if the mechanics lien is over the 90 days?

The deadline to file a Georgia mechanics lien is 90 days after last furnishing labor or materials to the job. So, if more than 90 days have passed after last furnishing and no lien has been filed, then a valid and enforceable mechanics lien can't be filed. If the lien has already been filed beyond its deadline, it's still possible that the lien could lead to payment. And, for help applying pressure, a Notice of Intent to Foreclose is a good additional step to help force payment. But, if the lien is challenged or if it comes time to enforce the lien, then a lien filed beyond its deadline will very likely end up being invalid and unenforceable. Though, even if the lien doesn't lead to recovery, there are always other options outside of the lien process. Finally, if the mechanics lien has already been filed on time, then the deadline to enforce the filed lien is 365 days from the date when the lien was recorded. So, that 90-day deadline won't matter if the lien has already been filed.
