Is there any distinction between owner occupied and non owner occupied projects?

On residential owner-occupied projects, only claimants having a written contract signed by the owner-occupant are permitted to record a mechanics' lien against the property. That is really the only special rule that applies to mechanic's liens on owner-occupied projects. The rules for preliminary 20-day notices are the same. You should be filing preliens routinely on the first day of the project without exception. It would also be good to consult with a lawyer about your form prelien to make sure you are doing it right.
