Can General Contractors withhold a check from a subcontractor because the total dollar amount of the Supplier and Installer Conditional Lien Waivers from that period is more than the amount of the check being cut to the Subcontractor for that same period? We are a flooring Subcontractor. We have been requested from a General Contractor to collect Conditional Lien Waivers from all our Suppliers and Installers. The total dollar amount of the Conditional Lien Waivers is more than the amount we are receiving a check for from April's Pay Application. Because of this, they are refusing to cut us a check. Is this legal in the state of Georgia?
