Good morning, We had a company that we pre-liened but they're not in the game anymore and Liberty Insurance took over their place. A company by the name of Vertex is now managing in place of Vila. How do we now go about pre-liening Vertex or can we? Please advise. Thank you, Bobbie Cantu

Hi Bobbie, I am not sure exactly what you mean. Are you a supplier or contractor that is owed money on a public or private project and trying to determine who you need to serve a prelim on? Is your customer the GC? Best, Chris

We are a contractor that is owed $$ on a public project and we are trying to determine who we now prelien. The customer is now Liberty Insurance who in turn hired Vertex, to manage the job. We need to know how to prelien this job.

Thank you! It sounds like your contractor was terminated or otherwise removed from the project. To be safe, I would prelim both Liberty (who I assume is the performance bond surety who has taken over the job and hired Vertex) and Vertex, as well as the public entity. This assume Vertex is now the direct contractor/GC to the public entity. Typically, you do not have to send a prelim to a bond surety, but in this type of situation, it surely can't hurt.
