Parent Company in Texas for a residential project for contractor in NY

New YorkMechanics LienNotice of Intent to Lien

Hello, I am unaware how the laws apply. A property preservation company in Texas hired contractor in NY. Property is located in NY. Do NY laws apply or Texas for non payment? Also if the intent to lien is ignored, what state is the lien filed? On the actual property or the companies property. Thank you so much. I feel like God has blessed me to find you all.

Mechanics lien claims tie directly to the project property, so the lien laws of the state where the work is performed will apply. Further, the lien ties to the project land - not against a particular person or contractor. So, if work is being done in New York, the New York mechanics lien laws will apply - and you can learn more about those laws here: New York Mechanics Lien Guide and FAQs. Of course, that also means the lien would be filed in New York (if necessary), and Levelset has some information that should help with that, too: (1) How to File a New York Mechanics Lien – Step By Step Guide to Get You Paid; and (2) Guide to New York County Recorders. I hope this information is helpful, but more importantly, I hope you're paid before any of these mechanics lien law considerations even come into play! As you hinted at in your question above, sending a Notice of Intent to Lien will often be enough to get paid, all by itself.
