Our lien rights have expired. Do we have other options to try to collect?

CaliforniaMechanics Lien

We are a subcontractor who provided work on this project. Our last day working on the project was in May, 2022. We are in the process of changing ownership. Me and Admin Support both failed at staying on top of lien right periods. They filed a Notice of Completion within the past 30-Days per Levelset. Do we have any other options available to try to collect the balance of money owed for the work we completed, per contract? Thank you; I appreciate your service.

You can file a "Breach of Contract" lawsuit against the prime contractor. OR if your still within the 30 Days of the Notice of Completion being filed you can contact levelset directly to file the mechanics lien, assuming you served the owner with a preliminary notice.

Thank you Mr. Berkley for your time spent responding back to my question. Do you know if Levelset is able to provide me with the date of the N.O.C., or where I can go to get this information?...thanks again for your time.

If you received the notice within the last 30 days your probably within the 30 days, but you can check with the County Recorders Office. Some counties the information is available online, but others you would have to go to the County Recorders office in person to check. Levelset may provide a service to check for you, and i bet they probably do, but I don't know. You could call them and ask.
