Our contractor who is not licensed in FL filed a lien against multiple properties for the same amount

Our general contractor filed liens against all 5 of our properties for the same amount, over $31000 each. We have paid shim everything but maybe $10,000 (he has not submitted all mileage logs or reimbursement receipts). We do not know how he came up with the amounts but we are in the process of selling the houses and his lien is posing problems. What can we do to get these overturned? He did work on all houses but they all have items still that need to be fixed.

If a contractor lied about having a license and you recently learned that they are unlicensed, there are certain legal rights available to you that may entitle you to rescission of the monies already paid to the unlicensed contractor. With respect to the overstated liens referenced in your question, through the help of an attorney you can contest the liens and potentially have them satisfied in 60 days or less.

Florida law does not permit unlicensed contractors to enforce Claims of Lien. 489.128 prohibits unlicensed contractors from enforcing their contracts in law or equity, and Florida law only allows a lien where it is based upon a contract. If the contract is unenforceable, then no lien right exists. Consultation with an attorney experienced with construction licensing and the lien law is necessary to resolve this situation.
