Our contractor has not done any work on our project in over 2months. Keeps making excuses on why no one has been here.

We are finishing our basement snd had a contractor start the project early December 2020. The contract stated the project would be done the end of February 2021. It is now mid July 2021 and we haven’t had a contractor at our house doing work in 2months. We have paid the contractor about 25k towards the project already.

File a claim with the local consumer affairs. You should be able to find the information online.

this is not a great situation. First, do not pay any more money. Second, verify the contractor's home improvement license and see assistance from our local agency. Third, terminate the contractor and try and get the job finished. if you have cost overruns becasue of the contractor, you may need to consult a lawyer. good luck

We now have not heard from him in a month. Not returning our messages. We sent him a certified letter and it was undeliverable. I am assuming he doesn’t live at that address anymore. We have filed a claim with the better business bureau. Do we find someone to summons him? Do we reach out to a lawyer? We are in upstate NY near Saratoga Springs. Any suggestion and guidance would be greatly appreciated. We have been in contact with another contractor to see what the cost is to finish the job.

If you filed a claim with BBB, that’s a start. You should also file a claim with consumer affairs in your county. As far as suing him, if you can’t locate him, it will be tough to sue him. He needs to be served with the lawsuit. My suggestion is to get the work done with another contractor. You can decide to sue him afterwards.
