I have a customer that wants to enter into a payment agreement. If they default have we lost our lien rights?
If you do not file a lien within the legal time limit, you have lost your lien rights. That said, you can have a payment agreement which allows you to file the lien within the time limit even if payments are being made. Or you can enter into a payment agreement which creates a mortgage lien upon the property.
