notice sent 4/7/20, can we still file Claim of Lien?

FloridaLien Deadlines

Order #: 3341065 Hello, we filed our notice of intent on 4/7/20 but did not follow through with Claim of lien since it appeared the property owner would pay. They have since defaulted and we would like to know if we may still complete the Lien or if we need to fill a new Notice of Intent.

A Notice of Intent to Lien isn't a required step under Florida's mechanics lien laws, but it is a very useful/effective way to induce payment before resorting to filing a lien claim.

That being said, the deadline to file a lien in Florida is 90 days of last furnishing labor and/or materials to the project. This is a hard deadline, and if the claim isn't filed within this time frame, the claimant will lose their right to file a lien for the labor and/or materials furnished.
