Notice extending time to file mechanic's lien statement -

We are an electrical company and need to file a lien. Our last day on site was some time ago but we only final invoiced 2 weeks ago so we would like to file an extension on the project and not jeopardize our lien rights.

Colorado's mechanics lien deadline will typically be 4 mths after last furnishing labor or material to the project. As you mention above - it's possible for CO lien claimants to extend the filing timeframe. Though, the lien extension must be filed within the deadline, too. So, if more than 4 months passed after last furnishing - the lien filing deadline can't be extended after the fact. Finally, keep in mind that if your lien deadline is closing in, you may want to consider sending a Notice of Intent to Lien. That document must be sent at least 10 days before the mechanics lien deadline, and it can actually spur payment itself. So, it can be really useful when payments are coming slow and when it looks like a lien will be necessary. And, if a Notice of Intent to Lien isn't property sent first, a valid mechanics lien can't be filed.
