You are eligible to make a Miller Act claim if you are a first or second tier sub or supplier on a federal project. If you are a second tier sub, you must be sure to submit notice of your claim to the prime contractor within 90 days of your last day furnishing labor, equipment, or materials. The notice should be sent via certified mail to the prime contractor's address and must include the following information: (a) the claimant has furnished and labor and material to the project, (b) who the work and/or materials were supplied to, and (c) the balance owed. If you are a first tier sub, you might also send notice, but it is not required. In both cases, you must file suit within one year of furnishing work on the Project but no soon than 90 days after your final day furnishing work.
