My lien expired but I did do work after before the lien expired and I asked for payment and I wasn’t paid still

WashingtonLien Deadlines

My lien expired but I did do work after before the lien expired and I asked for payment and I wasn’t paid still I already had a lien filed and it’s been past eight months of collecting but 90 days ago I went and collected the rest of my belongings off the residence where my job was so I’d like to open a new claim to be paid for the full amount of work that I completed and have receipts for

In the state of Washington, parties that go unpaid for furnishing labor or materials to a construction project must file their mechanics lien within 90 days of the last furnishing to the project. The deadline for filing a mechanics lien is very strictly adhered to. However, the Washington mechanics lien deadline may be extended for a very short period of time ONLY IF the deadline ends on a weekend or holiday.

Once your initial lien expired, if you were interested in refiling a mechanics lien, the only answer to that question is NO. Once a lien expires, it is gone forever, and the only way you could possibly refile your lien is if you were still within the original lien period.

In the absence of mechanics lien rights there are a few potential steps that may be taken which include:

1. Send the property owner a notice of intent to lien

2. Send to collections

3. File suit

I hope that helps!

No, you don't have lien rights but you can always sue the owner in general for the amount unpaid.
