My former employer has some of my tools I used on the job. How can I get them back?

Tennessee

I worked for a home improvement company. I quit & they now have a ladder and some tools that I own. They are really upset & refuse to answer when I ask for my things back. What legal rights do I have.

When construction tools are being held hostage, it might help to start with a written demand for the return of the tools. While phone calls can be hung-up, a written demand for the tools is pretty undeniable. And, having a written showing that you tried to resolve the matter amicably might be helpful moving forward. One option that some workers choose to pursue is filing a police report. It's a bit of a dramatic reaction, but it could be an effective step toward recovering property. Of course, the mere threat of involving the police in the dispute may be enough to have the company consider releasing the tools being improperly held. Further, filing an action in small claims court alleging the theft of the tools and demanding their return may be helpful too. Small claims court tends to help speed legal disputes along and helps to avoid a lot of the cost associated with litigation. And, just like filing a police report, threatening to pursue a small claims action might convince a former-employer to return tools being improperly withheld.
