If this was a residential lien, and it appears it is, then you will need to argue the service question before an arbitrator, and arbitration needs to be demanded before the American Arbitration Association within 10 days of service of the lien. Defective service of a lien is not always fatal depending on the circumstances. There are some cases where the defective service was ignored so long as there is no evidence that the defective service harmed the Owner in some way.

Your question cannot be answered without seeing the underlying documents and understanding the contract and project. Please reach out and email me the documents if you want a NJ construction lawyer to review.
