my contractor has not gotten in touch after we pay to start a new house project.

TexasConstruction Contract

I hire a contractor from buildzoom a company like Angies list. We hire him for a new construction. We paid him for the blue prints and to start the construction. We had a financial issue on his end and than we had an issue with my land. It needs to have a replat done in order to get the financial started so he offer to help and we paid him again to start the replat. Since than we have not heard from him I have send him emails and messages. He has not yet respond to neither phone or text and its been 3 months now. There is also no date on the contract.

When a downpayment has been paid to a contractor, but where that contractor has gone MIA, it can be hard to decide how to proceed. But, before deciding to try and terminate the contract or before deciding to pursue legal options, it's typically a good idea to send a contractor written notice regarding the failure to perform work. Notifying a contractor that their contract will be terminated and/or that legal options will be explored can help to either get the project back on track, or it will help to draw a line in the sand regarding the project's termination. Of course, how to proceed should be directly informed by the text of the contract, itself. So, if the contract provides guidance on how to act (regarding the project schedule, failure to perform work, or termination), it should generally be followed. I hope this was helpful!
