Mechanics lien tenant improvements

Death of owner. Tenant performed upgrades to property, property now sits in undetermined ownership. Can I file a mechanic lien for recourse? Edward.

Yes - someone owns the property. If you are a subcontractor, you have 30 days from recordation of a Notice of Completion (NOC) to record a lien, or 90 days after completion of the project (not just your scope of work, but the entire work of improvement) if no NOC is recorded. If you are a GC, it is 60 days and 90 days, respectively. You must file suit within 90 days of recording the lien. Good luck.
