mechanics lien

South Carolina
James Counihan

I filed a mechanics lien with levelset within the time frame but I understand that the foreclosure deadline has passed. I still have not received payment so I am wondering what my next steps are? The owner of the property where the work was completed keeps saying he is going to pay but this has been going on since 10/2021.

In South Carolina to enforce a mechanic's lien you are required to file a lawsuit to foreclose the lien within 6 months of the last date of supply of labor or material to the Project. It sounds like that time has passed and so the lien is no longer enforcable. However, you still may have rights under a breach of contract claim or other legal theories.
