When a South Carolina mechanics lien is filed on a property it's only valid for 6 months from the last day that labor or materials have been provided. During this 6 month period, a lien claimant may file a foreclosure (enforcement) action on the property if they are still unpaid. If no action is taken within the 6-month period, the lien will expire a no longer be valid and enforceable. One way to avoid this is to do what's known as "bonding-off" the lien. This involves taking out a surety bond that will act as a replacement for the property. That way the property will no longer be subject to a foreclosure action. But, this doesn't get rid of the mechanics lien, this only substitutes the property for a surety bond; so the contractor will still have a claim. Something to keep in mind is that just because a lien is filed, doesn't necessarily mean it's valid. County recorder's offices do just that.
