Lis Pendens same as Lawsuit?

FloridaLien Foreclosure

I may have to file a lis pendens for a Claim of Lien filed. Is it the same as filing a lawsuit or does a lawsuit have to be filed as well? I just want to cover all bases in case our Claim of Lien is contested. Does it have to be filed by an attorney?

A lis pendens is not he same thing as a lawsuit. A lis pendens is a document you record in the official records in the county in which the property lies, that tells the world that you have filed a lawsuit to enforce your lien rights.

It's important to note that recording the lis pendens does not extend the time limits for filing suit to foreclose the lien.

One reason it's important to record a lis pendens is to ensure that your lien is effective against other lienors or subsequent purchasers. As always, talk to a construction lawyer about your particular situation and to get more detail.
