Lien was filed on incorrect location

GeorgiaLien Releases

My company was hired by a management company to provide contractor services inside of several units at a condominium location. At the time of the service it was my impression that the units were part of an apartment complex so when they didn't pay, I filed a lien on the property through Levelset on the Condo Association for which I received a phone call from their attorney in dispute. I had not intended to file a lien on the common elements of a condo association and the lien needs to either be canceled or released. Please contact me to advise which steps I need to take to resolve this issue. Thank you.

Generally in Georgia, the property to which a mechanics lien attaches is dependent on whether the property is "submitted property" and on the specific work performed. When a condominium is "submitted property" (which, according to the GA Condominium Act, is “property lawfully submitted by the recordation of condominium instruments”) liens for the original construction of any part of the property attach to the property as a whole; liens for work performed on individual units attach to the individual units; and liens for work performed on common elements attach to each individual condominium unit proportionally. A release or cancellation can be ordered through your account. I will also have someone from our support team reach out to you.
