Lien Threat

New JerseyLien on Funds

Hi, We hired a tree company to take down some trees and the subcontracted the stump removal to a company we didn't hire. That stump removal company cut the wire to our pool which we learned from an electrician that it is up to code. Who also concluded that it was the wire that was cut by the stump removal company. We paid the tree company but haven't paid the stump removal company because we want our pool wire to be fixed. We also never agreed in a contact or verbal agreement of the price for the stump removal company. Now the tree company is threatening to put a lien on our house for the unpaid balance of the stump removal company. Can they do this?

A written contract is required to file a lien in NJ. If you did not sign any agreement, the stump removal company will be out of luck.
