Having your mechanics lien bonded off isn't necessarily a bad thing. In fact, then a mechanics lien is bonded off, that means, if worse comes to worst, funds are there to ensure that payment gets made. Essentially, when your lien is bonded off, the lien gets transferred from the property title to the surety bond. And, if filing an enforcement suit becomes necessary, the claimant will file that enforcement suit against the bond rather than the property. And, claimants should assume that their original enforcement deadline will apply. Though, that enforcement must also be made within 1 year from when you receive notice that the lien has been bonded off. Ultimately, if your lien does get bonded off, the steps for recovery should be pretty similar - and Levelset discusses potential next moves here: The 4 Steps to Take After Filing a Mechanics Lien. And, if it looks like the dispute won't be quickly resolved, consulting with a Texas construction lawyer will help to ensure you're paid what you're owed and that you don't miss any relevant deadlines.
