Lien removal by client

Washington

We have a client who has refused to pay and terminated the contract for convenience. We filed a lien to protect our payment rights and they have gotten legal council to recommend petitioning for a lien removal. However, they are in breach of contract by not paying the outstanding balance upon terminating the contract. What are the recommended next steps?

If the client's attorney wants to bring a frivolous lien claim, you will have to defend it. But, if the client owes you money and the lien was filed within 90 days from the last day of work, they probably won't be successful. You do have to foreclose the lien within 8 months of filing it, or it will be lost.
